For the purposes of this Licence, unless the contrary intention appears:

‘Act’ means the Environmental Protection Act 1986;

‘AHD’ means the Australian height datum;

‘Allen Road Irrigation Treefarm’ means the location Lot 11684 and Lot 11685 on Plan 157152, Allen Road, Walpole Western Australia as defined in the Premises Map in Schedule 1;

‘applicable guidelines and standards’ means:

i) Australian and New Zealand Environment and Conservation Council and Agricultural and Resource Management Council of Australia and New Zealand 2000, Australian and New Zealand guidelines for fresh and marine water quality Volume 1, specifically the values for a south-west Australian slightly disturbed ecosystem lowland river and estuaries (Table 3.3.6); and

ii) Department of Environment and Conservation 2010, Contaminated site management series assessment levels for soils sediment and water, Government of Western Australia;

‘AS/NZS 2031’ means the Australian Standard AS/NZS 2031 Selection of containers and preservation of water samples for microbiological analysis;

‘AS/NZS 5667.1’ means the Australian Standard AS/NZS 5667.1 Water Quality – Sampling – Guidance of the Design of sampling programs, sampling techniques and the preservation and handling of samples;

‘AS/NZS 5667.6’ means the Australian Standard AS/NZS 5667.6 Water Quality – Sampling – Guidance on sampling of rivers and streams;

‘AS/NZS 5667.10’ means the Australian Standard AS/NZS 5667.10 Water Quality – Sampling – Guidance on sampling of waste waters;

‘AS/NZS 5667.11’ means the Australian Standard AS/NZS 5667.11 Water Quality – Sampling – Guidance on sampling of groundwaters;

‘averaging period’ means the time over which a limit or target is measured or a monitoring result is obtained;

‘CEO’ means Chief Executive Officer of the Department of Environment Regulation;

‘CEO’ for the purpose of correspondence means;

‘Water Corporation Environmental Improvement Program Upgrade Works’ means the document titled Water Corporation Environmental Improvement Program Upgrade Works, provided to the Department of Environment Regulation on 4 June 2014;

‘freeboard’ means the distance between the maximum water surface elevations and the top of retaining banks or structures at their lowest point;

‘hardstand’ means a surface with a permeability of 10-9 metres/second or less;

‘Licence’ means this Licence numbered L8021/2003/5 and issued under the Act;

‘Licensee’ means the person or organisation named as Licensee on page 1 of the Licence;

‘malfunction’ means to fail to work or operate correctly and includes the failure or incorrect operation of any part of the wastewater treatment system;

‘NATA’ means National Association of Testing Authorities, Australia;

‘Premises’ means the area defined in the Premises Map and labeled Walpole Wastewater Treatment System in Schedule 1 and listed as the Premises address on page 1 of the Licence;

‘quarterly’ means the 4 inclusive periods from 1 July to 30 September, 1 October to 31 December and in the following year, 1 January to 31 March and 1 April to 30 June;

‘Schedule 1’ means Schedule 1 of this Licence unless otherwise stated;

‘Schedule 2’ means Schedule 2 of this Licence unless otherwise stated;

‘spot sample’ means a discrete sample representative at the time and place at which the sample is taken;

‘storage dam’ means the dam located at the Allen Road Irrigation Treefarm;

‘treated wastewater’ means wastewater that has been treated by the wastewater treatment system; and

‘wastewater treatment system’ means the system from treating wastewater at the Premises which comprises of the macerator or spiral screw screen, bioselector, alum and caustic dosing, intermittent decant extended aeration, aerobic digester, equalisation and geobag sludge drying with leachate return and all pumps.

1) Nothing in the Licence shall be taken to authorise any emission that is not mentioned in the Licence, where the emission amounts to:

(a) pollution;

(b) unreasonable emission;

(c) discharge of waste in circumstances likely to cause pollution; or (d) being contrary to any written law.

2) Any reference to an Australian or other standard in the Licence means the relevant parts of the standard in force from time to time during the term of this Licence.

3) Any reference to a guideline or code of practice in the Licence means the version of that guideline or code of practice in force from time to time, and shall include any amendments or replacements to that guideline or code of practice made during the term of this Licence.

4) The Licensee shall:

(a) ensure any waste accepted to the inlet works on to the Premises is sewage waste from the reticulated sewerage system; and

(b) not cause or allow the acceptance of wastewater to the Premises greater than the limit of 200 m3/ day as measured at reference point M1 (as depicted in Schedule 1).

5) The Licensee shall manage the wastewater treatment system such that:

(a) overtopping of the wastewater treatment vessels does not occur;

(b) overtopping of the hardstand for sludge/geobag dewatering does not occur;

(c) there is no discernible seepage loss from the wastewater treatment vessels;

(d) there is no discernible seepage loss from the hardstand for sludge/geobag dewatering;

(e) leachate from the hardstand for sludge/geobag dewatering is returned to the wastewater treatment system; and

(f) the volumetric flow meters located at the monitoring locations M1, M2 and M5 as depicted in Schedule 1 are maintained to the manufacturers specifications.

EMISSIONS TO LAND

6) The Licensee shall only direct:

(a) treated wastewater via the effluent pressure main from the treated effluent pumps to the storage dam as depicted in Schedule 1; or

(b) wastewater from the wastewater treatment system to the infiltration trench as depicted in Schedule 1 in a breakdown or emergency situation.

MONITORING CONDITIONS

7) The Licensee shall undertake the monitoring in Table 2 according to the specifications in Table 2.

8) The Licensee shall undertake the ambient environmental monitoring in Table 3 according to the specifications in Table 3.

9) The Licensee shall ensure that all laboratory samples are submitted to and tested by a laboratory with current NATA accreditation for the parameters being measured unless indicated otherwise in Table 2 and 3.

10) The Licensee shall complete the improvements in Table 4 by the date of completion in Table 4.

12) The Licensee shall by 1 September in each year, submit to the CEO an Annual Environmental Report for the conditions of this Licence and any previous licence issued under Part V of the Act for the Premises, during the period beginning 1 July the previous year and ending 30 June in that year. The report shall contain:

(a) a discussion of the operation of the project, compliance with conditions and its environmental performance to date;

(b) all monitoring data or other collected data required by any condition of this Licence (data shall be provided in tables and in graphical format displaying a minimum of five year data trends where available);

(c) a summary of discharges to the irrigation trench including the dates that the discharge occurred and the volumes discharged;

(d) an assessment of all monitoring data against any targets, limits and applicable guidelines and standards detailed within this Licence;

(e) any changes to site boundaries, locations of monitoring sites, surface drainage channels, tenure and maintenance upgrades to the Premises;

(f) a list of any monitoring methods used to collect and analyse data required by any condition of this Licence;

(g) the monthly load (as kilograms per day) of the parameters in the wastewater discharged from the Allen Road Irrigation Treefarm using monthly average flow- weighted data and parameter concentrations, as measured in accordance with Condition 9, Table 2; and

(h) a summary of the number and type of environmental complaints received by the Licensee

ANNUAL AUDIT COMPLIANCE REPORT

13) The Licensee shall by 1 September in each year, provide to the CEO an Annual Audit Compliance Report in the form in Schedule 2 to this Licence, signed and certified in the manner required by Section A, B and C of the form, indicating the extent to which the Licensee has complied with the conditions of this Licence, and any previous licence issued under Part V of the Act for the Premises, during the period beginning 1 July the previous year and ending on 30 June in that year.

1 Purpose of this Document

This decision document explains how DER has assessed and determined the application and provides a record of DER’s decision-making process and how relevant factors have been taken into account. 3 Executive summary of proposal and assessment

The Walpole Wastewater Treatment Plant (WWWTP) is located within the Shire of Manjimup in the light industrial area of the town of Walpole. The nearest residential neighbours are located about 600 meters (m) to the southwest. The Premises is surrounded by Walpole-Nornalup National Park to the west, north and east with the light industrial area located adjacent to the south. The Collier Creek south coast significant wetland is located about 500 m to the south and an unclassified south coast significant wetland is located about 500 m to the north. The WWWTP is located within seven

threatened ecological site buffer areas and about 1,200 m south of the priority 1 and priority 2 Butlers Creek catchment areas. Minor perennial creeks that drain into the Walpole and Nornalup Inlets Marine Park are located about 450 m to the west (Butlers Creek) and 300 m to the east (Collier Creek) of the WWWTP. The Walpole and Nornalup Inlets Marine Park, an estuarine environment that is open all year round, is located about 1,250 m southwest of the WWWTP.

The WWWTP was originally constructed at a 100 kL/ day capacity in 1999 following a consultative environmental review and the issuing of Ministerial Statement 493. Under works approval

W3786/2003/1 the WWWTP was upgraded in 2005 to a 200 kL/ day capacity. This coincided with the construction of the nearby Allen Road Irrigation Treefarm (ARIT) premises. The WWWTP and ARIT premises were both managed under the one licence until 2014. A pipeline conveys treated

wastewater approximately 800 m through the Walpole-Nornalup National Park to ARIT.

The current WWWTP consists of the following operations and infrastructure:

 Elevated inlet works and inlet screen;

 Chemical dosing facilities for alum (5 kL) and sodium hydroxide (5 kL);

 Biological nutrient removal;

 Intermittent decant extended aeration/ activated sludge plant;

 Sludge management facilities comprises of two waste activated sludge (WAS) storage/thickening geotube installations;

 Treated effluent transfer pump station;

 Emergency discharge infiltration trench; and

 Operations and switch room facilities contained within a transportable building.

Discharges of treated wastewater to land are managed by treating wastewater to a defined water quality level prior to additional storage and treatment at the ARIT 39 megalitre storage dam and dosing pump station. The main potential emissions from the WWTP are emergency discharges to the infiltration trench. Discharge to the infiltration trench is only undertaken during emergency breakdown situations. The infiltration trench, the original discharge point for the WWWTP, has a capacity of approximately 60kL/ day. Solid sludge waste may also result in leachate and fugitive emissions in the form of odour. Sludge waste is stored within Geotube installations with leachate returned to the wastewater treatment system.

This Licence is the successor to licence L8021/2003/4 and includes the following changes:

 Administrative updates, including contact details for the Department of Environment Regulation and condition numbering;

 Addition of a condition to ensure that emissions not authorised through the licence comply with the provisions of the Environmental Protection Act 1986 (new condition 1).

 Removal of a condition requiring treated wastewater quality targets to be met;

Fugitive emissions (Odour)

Emission Description

Emission: Odour may be generated from the WWWTP treatment process, sludge storage compound and as a result of abnormal operating conditions.

Impact: Interference with the health, welfare, convenience, comfort or amenity of sensitive commercial and residential receptors is possible. Commercial receptors are located adjacent to the south and the closest residential receptors are located about 600 metres to the southwest. No odour complaints have been identified in association with the operations at the WWWTP.

Controls: Liquid waste is treated and maintained within the Intermittent decant

extended aeration/ activated sludge plant. Sludge in managed via geo tube two waste activated sludge (WAS) storage/thickening geotube installations.

It is considered that the provisions of Section 49 of the Environmental Protection Act 1986 are sufficient to regulate potential fugitive (odour) emissions from the liquid waste facility and any other fugitive emissions arising from activities at the Premises.

The risk of emissions and associated assessment of those emissions has not been undertaken as part of this reissue and is subject to a review of the ARIT premises operations. Subsequently consideration for 20 year licence
