The Committee agreed to write to the organisations that had made submissions asking them to comment on the Department's responses to the Committee's questions on the NTCAT

4. NORTHERN TERRITORY CIVIL AND ADMINISTRATIVE TRIBUNAL AMENDMENT BILL Mr Collins moved and Mr Costa seconded that:
The Committee authorises the publication of the written responses from the Law Society NT and the Darwin Community Legal Service.

The Committee considered the responses from the Department of Attorney-General and Justice, the Law Society NT and the Darwin Community Legal Service.
Mr Collins proposed to provide a re-draft of the proposed amendment 101A Default decisions for the Committee to consider.
The Committee agreed to include in the report recommendations that the proposed amendment on default decisions require applicants to submit an affidavit of service and an affidavit outlining evidence of the debt.

The Committee noted the correspondence.
Regarding Item a) of the correspondence, the Chair noted that he had spoken to the Department of Attorney-General and Justice regarding their response to the Committee's queries on the NTCAT Amendment Bill 2018 and that, at this point, a letter is not required.
However, the Committee agreed that if future responses from the Department are not adequate the Chair will write a formal letter of concern.
3. NORTHERN TERRITORY CIVIL AND ADMINISTRATIVE TRIBUNAL AMENDMENT BILL Mr Collins moved and Mr Costa seconded that:
The Committee adopt the report for the Inquiry into the Northern Territory Civil and Administrative Tribunal Amendment Bill 2018.

Water Legislation Amendment Bill 2018
The Committee agreed to hold a public briefing with the Department of Environment and
Natural Resources on 3 October 2018, subject to availability of members.1

The Chair welcomed Ms Kate Worden to the Committee and thanked Mr Collins for his work on the Committee.
2. ELECTION OF DEPUTY CHAIR
The Chair called for nominations for Deputy Chair.
Mr Costa nominated himself for Deputy Chair of the Committee. Ms Worden seconded the nomination.
As there were no other nominations, the Chair declared Mr Costa to be elected Deputy Chair of the Committee.

The Committee write to the Minister requesting a response to a question on proposed Section 5 of the Medical Services Amendment Bill 2018.

7. LIQUOR AMENDMENT BILL 2018
The Committee agreed to the Secretary making a tentative booking for a public hearing on the Liquor Amendment Bill, pending a review and analysis of submissions to be provided at the next meeting on 14 February 2018.
8. PETROLEUM LEGISLATION AMENDMENT BILL
The Committee agreed to the Secretary making a tentative booking for a public hearing or briefing on the Petroleum Legislation Amendment Bill, to be held on same day as the tentative public hearing for the Liquor Amendment Bill, pending a review and analysis of submissions to be provided at the next meeting on 14 February 2018.

2. That if further clarification is required after receiving the Minister's response, the Committee hold a public briefing with the Department on the Petroleum Legislation Amendment Bill 2018, on the 25 February 2019.

Mr Higgins noted his concern that when the Committee's reports on Bills propose significant recommendations there may not be sufficient time for stakeholders to express their views on the recommendations before they are considered by the Assembly and the Bill is passed.

» The rationale for using pension age as the main factor for limiting the amount of time a person can receive loss of earning capacity (LOEC) benefits (e.g. was this informed by average length of time on LOEC benefits, the aggregated average benefits paid out for LOEC, driver risk by age)
« How entitlements to loss of earning benefits vary by the following age groups - 45,64, 67, 75 and 80.

3. MOTOR ACCIDENTS (COMPENSATION) AMENDMENT BILL 2019
Ms Warden noted that there appeared to be an error in the answer provided by the Department to question 1b of the Responses to Written Questions, with Table 1 stating that a person aged 64 would only receive LOEC benefits until pension age. The Committee agreed that the
Department's second set of Responses to Written Questions should not be published until this apparent error has been clarified with the Department and corrected if necessary.

4. WATER AMENDMENT BILL 2019
Ms Warden noted that Minister Lawler's letter did not provide clear agreement for the Committee to publish the Department's written responses to questions on the Committee's webpage. The Committee agreed that publication of the responses would not be authorised until Mr Sievers had followed this up with the Minister.
