The Committee adopt the 'No Issues' report, Inquiry into the Education and Care Services (National Uniform Legislation) Amendment Bill 2019, to be presented to the Speaker on Tuesday 2 July 2019 pursuant to SO 200(4) for subsequent tabling in the Assembly on Tuesday 6 August 2019.

4. ENVIRONMENT PROTECTION BILL 2019

The Committee authorise publication of the submissions received with the exception of submission 9 which the author requested not be made public on the Committee's website.

1. That the Committee authorises the publication of the written responses to

questions on the Liquor Bill 2019 provided by the Department of the Attorney-

General and Justice.

2. That the Committee authorises publication of papers tabled at the public hearing

on the Liquor Bill 2019 held on 10 July, excepting Tabled Paper 1-2 - Case study

of vehicle seizure for which NAAJA requested confidentiality.

3. That a Chair's draft report be prepared for the Inquiry into the Liquor Bill 2019.

Mrs Warden requested that a question regarding the effect on the operation of the Bill of

prohibiting third party campaigners from acting in concert with others, in relation to expenditure, be included in the questions for the Department.

1. Call for submissions to its inquiries into the Water Further Amendment Bill 201 9 to

be received by 4 September 2019.

2. The Committee write to the Minister for Infrastructure, Planning and Logistics and the Minister for Environment and Natural Resources requesting contact officers for

the Transport Legislation Amendment Bill 2019 and the Water Further

Amendment Bill 2019, and inviting departmental representatives to appear before

the Committee at a public briefing on 21 August 2019.

NB: Submissions to the Transport Legislation Amendment Bill 2019 were sent out on 9 August

based on Committee's standard default procedure for inviting submissions (Meeting No. 2 Agenda).

Mrs Warden moved and Mr Collins seconded that:

1. The Committee authorises publication of the submission from the Department of Environment and Natural Resources on the Water Further Amendment Bill 2019.

2. The Committee authorises publication of the two sets of written Reponses from

the Department of the Chief Minister on the Electoral Legislation Further

Amendment Bill 2019.

The Committee agreed to draft a letter to Jodie Ryan, Chief Executive Officer of the

Department of the Chief Minister responding to her concerns regarding the form of

recommendations from scrutiny committees. The letter is to be distributed to Members prior to sending.

3. ANNUAL REPORT

Mrs Finocchiaro moved and Mr Collins seconded that:

The Committee adopt the Chair's draft Annual Report 2018-2019, to be presented to the

Speaker on Wednesday 4 September 2019 pursuant to SO 200(4) for subsequent tabling in the Assembly on Tuesday 17 September 2019.

4. ELECTORAL LEGISLATION FURTHER AMENDMENT BILL 2019

The Committee agreed that the Committee Secretary and First Clerk Assistant should arrange

a meeting with the Department of the Chief Minister to further clarify drafting issues in the Bill

and to incorporate subsequent amendments as recommendations into the draft report to be provided to the Committee at the next meeting on Wednesday 11 September 2019.

2. BUSINESS ARISING FROM PREVIOUS MINUTES

The Committee noted the response from Mr Michael Holmes (Director Lands Planning, Department of Infrastructure, Planning and Logistics) regarding zoning of Cemeteries. The Committee requested that the Committee Secretary obtain further advice regarding:

• The rationale for not permitting cemeteries in urban residential zones (Zones SD, MS, MR and HR) where undefined uses are prohibited; and

• Whether the zoning requirements for cemeteries has been, or is intended to be, reviewed in light of the proposed legislation.

3. CORRESPONDENCE

The Committee noted the letter from the Clerk regarding the drafting of scrutiny committee recommendation and agreed that the Chair should respond noting that:

• The Committee acknowledges the preference for recommendations to be drafted in the narrative where practicable;

• In accordance with its Terms of Reference, the Committee will continue to make well considered recommendations; and

• Suggest that the Office of the Parliamentary Counsel may wish to consult with other jurisdictions that have a similar Bill scrutiny process such as Queensland regarding the implementation of Committee recommendations.

4. ENVIRONMENT PROTECTION BILL 2019

Mr Paech moved and Mrs Worden seconded that:

2 The Committee adopt the Chair’s draft report, Inquiry into the Environment Protection Bill 2019 as amended to be tabled in the Assembly on Tuesday 17 September 2019.

Mrs Finocchiaro will provide a dissenting report on the Electoral Legislation Further

Amendment Bill 2019 by Friday 13 September 2019.

4. WATER FURTHER AMENDMENT BILL 2019

The Committee agreed to hold a public hearing on the Water Further Amendment Bill 2019 on Tuesday 24 September 2019. Proposed participants include Central Land Council, Northern Land Council, NT Farmers Association Inc, and staff from the Department of Environment and Natural Resources.

Mrs Finocchiaro moved and Mr Costa seconded that:

The Committee write to the Minister requesting responses to written questions on the Water Further Amendment Bill 2019.

5. TRANSPORT LEGISLATION AMENDMENT BILL 2019

Mr Collins moved and Mrs Finocchiaro seconded that:

The Committee write to the Minister requesting responses to written questions on the Transport Legislation Amendment Bill 2019.

6. OTHER BUSINESS

Mrs Finocchiaro requested that it be noted that she had recommended that a public hearing be

held on the Electoral Further Legislation Amendment Bill 2019.

The Committee adopt the Chair's draft Report for the Inquiry into the Transport Legislation Amendment Bill 2019.

4. SEX INDUSTRY BILL 201 9

The Committee agreed that the e-mail from Mr Rodney Jones would not be treated as a submission to the inquiry.

6. OTHER BUSINESS

Mrs Finocchiaro moved and Mr Costa seconded that:

(1) The Committee authorise the publication of the Map of Native Title Determination areas tabled by Northern Land Council at the public hearing on the Water Further

Amendment Bill on 24 September 2019.

(2) That the Committee authorise the publication of the written responses from the

Department of Infrastructure, Planning and Logistics on the Transport Legislation

Amendment Bill 2019.

1. The Committee call for submissions to its inquiries into Bills referred in the October

sittings to be received by Wednesday 13 November 2019

2. The Committee write to the responsible Ministers requesting a contact officer in relation to Bills referred in the October sittings and inviting departmental representatives to appear before the Committee at a public briefing on Wednesday 30 October 2019.

7. PETITION REFERRAL

Pursuant to Sessional Order 17(2), the Committee notify the Clerk that the Committee

recommends that the Assembly debate Petition No. 42.

2. Write to responsible Ministers requesting contact officers in relation to Bills

referred in September sittings and inviting departmental representatives to appear before the Committee at a public briefing on Tuesday 29 October 2019.

The Committee agreed to hold public briefings on Bills referred during the October sittings on 29 October 2019 after the public hearing on the Sex Industry Bill 2019.
